10. SMS Messaging Program

By opting in to receive SMS/text messages from The Leadership Institute LLC, you agree to the following: You consent to receive transactional text messages related to your interactions with our services, including appointment confirmations, scheduling reminders, order confirmations, account notifications, and service-related updates. Message frequency is up to 4 messages per month. Message and data rates may apply. You may opt out at any time by replying STOP to any message you receive. 16. Limitation on Time to File Claims

You must bring any claim relating to these Terms of Service or the Website within one (1) year of the event giving rise to the claim, or the claim will be permanently barred.

17. Class Action Waiver

Where permitted by law, you agree to bring any claims against us only in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

18. Waiver and Severability

Our failure to enforce any provision of these Terms of Service shall not be deemed a waiver. If any part of these Terms is found unenforceable, the remaining provisions will continue in full force.

19. Coaching Engagement Guarantees

Where a sales page for Marie Horvath's private one-to-one coaching engagement (the “Engagement”) expressly references the guarantees below, this Section sets out those guarantee terms. These are the guarantee terms referred to in our Terms of Purchase and Refund Policy.

These guarantees apply only to a paid Engagement entered into in writing with The Leadership Institute LLC. They do not apply to the free Strategy Call, which carries no obligation and no guarantee. Each guarantee has conditions. To rely on a guarantee you must meet its conditions, including taking part in the scope work the Engagement requires and, where stated, obtaining next-level scope agreed in writing with your manager.

Guarantee 1 — The 30-Day Verdict. In the first 30 days of the Engagement we complete the scope work together and take it to your manager. If you do not then have, in writing, exactly what the next level requires from you, you receive a full refund. Remedy: a full refund of the Engagement fees you have paid. The process and any timing requirements for requesting this refund are set out in your written engagement agreement.

Guarantee 2 — The Level Floor. When you are promoted, your first-year comp increase will be at least $65,000. The applicable remedy and conditions for this guarantee are stated in your written engagement agreement.

Guarantee 3 — The Two-Cycle Guarantee. Promoted within your next two promo cycles, or I keep coaching you free until you are. Condition: next-level scope must be agreed in writing with your manager inside the first 60 days of the Engagement. Remedy: continued coaching at no additional charge until you are promoted, as set out in your written engagement agreement, which also defines what constitutes a promo cycle for this purpose.

Where an Engagement is funded in whole or in part through an employer benefit (for example, Google's Hall Pass professional-development benefit), how any refund or other remedy is administered is set out in your written engagement agreement.

Marie Horvath / The Leadership Institute is an approved Google supplier, which allows eligible Google employees to cover her services through Google's Hall Pass professional-development benefit. This does not constitute endorsement, sponsorship, or certification of The Leadership Institute or its training by Google, and Google does not guarantee any career outcome. Google and Hall Pass are trademarks of Google LLC; The Leadership Institute is an independent provider and is not affiliated with, partnered with, or acting on behalf of Google. Benefit coverage is subject to Google's eligibility rules and approval and is not guaranteed.
